Duty of Disclosure

Before you enter into an insurance contract, you have a duty to tell us anything you know, or could reasonably be expected to know, that may affect the insurer’s decision to insure you and on what terms.

You have the same duty before you renew, extend, vary or reinstate a contract.

What you must disclose

You must tell us anything relevant to the insurer’s assessment of the risk — including information about the property, business activity, prior claims, or other matters that could influence the terms or acceptance of cover.

What happens if you do not disclose

If you fail to comply with your duty of disclosure, the insurer may reduce or refuse a claim, cancel the policy, or treat the policy as if it never existed. The consequences depend on whether the non-disclosure was fraudulent or innocent.
